Arruda's death was not the result of an
accidental bodily injury independent of all other causes.
It pays up to P250,000 in the event that the cardholder sustains
accidental bodily injury which results in loss of life, sight or limb;
Section I covers contract works against an all risks cover, and Section II provides indemnity to the insured contractor against his liability towards third parties for
accidental bodily injury caused to them, or for damage to their property as a direct result of the contractor's negligence whilst carrying out contract works at the site.
After initial notice of
Accidental Bodily Injury or Sickness or Disease the Insurers shall be allowed to secure the Insured's medical records, to monitor treatments and/or to send any medical examiner selected by the Insurers to examine the Insured and every facility shall be given for such examination.
The occurrence definition makes it clear that coverage under a CGL form is meant for
accidental bodily injury or property damage.
Additional coverage can include "Voluntary Medical Payments" that will pay for medical, dental, hospital, nursing, ambulance and funeral expenses resulting from
accidental bodily injury caused to a person as a result of maintenance or use of the premises or the personal acts of an insured.
* An accident only disability income rider with higher issue rates that provides a monthly income for those who have become totally disabled due to an
accidental bodily injury.
A further pounds 2million is also included in the cover for any legal liability that arises from
accidental bodily injury or accidental damage to a property.
Generally speaking, it makes the insurer strictly liable for employees'
accidental bodily injury or disease arising out of and in the course of employment.
It states: "A board of education will save harmless and protect all teachers from financial loss arising out of any suit or judgment by reason of alleged negligence or other act resulting in
accidental bodily injury of accidental damage to property of any person within or outside the school building, provided such teacher, at the time of the accident or injury, was acting in the discharge of their duties within the scope of their employment." Section 3023, however, will not hold teachers harmless if they intentionally hurt students.
