The records established that SYMS executed the purchase of developmental air rights held by the owner of 44 Trinity Place ("44 Trinity"), the building adjacent to the 42 Trinity parcel, on December 28, 2007.
Both December 28th documents, the developmental air rights agreement and the "Zoning Lot Development Agreement," were executed by SYMS former Chief Financial Officer and former Board Member, Antoine Moreira (who strangely resigned from the Company without explanation just a few weeks after we filed our lawsuit against the Board of Directors in late January 2008).
This purchase permitted SYMS to develop a much larger building on the 42 Trinity parcel than what was previously allowed.
