Genentech admitted that from 1985 to 1994, it aggressively marketed Protropin, a synthetic human growth hormone, to doctors, hospitals, and others for use in the treatment of various medical conditions for which Protropin had not received FDA approval.
The government alleges that in 1986 and 1987, Caremark and the Genetech vice president agreed to pay Brown 5 percent of the annual gross revenues from the sale of Protropin generated by Brown's prescriptions, and that this agreement and payments made pursuant thereto violated the act.
