The move comes in the wake of the
Arc21 incinerator ruling in which a judge decided a top civil servant had gone beyond his powers in giving the Mallusk facility the go-ahead despite some public opposition.

He added: "The permanent secretary may hide behind this ruling after the
Arc21 court but that was controversial.
The department's head civil servant Peter May approved the PS240million Mallusk facility for
arc21 last September.
But a consortium behind the project on behalf of six local councils,
arc21, was given permission after the Planning Appeals Commission recommended approval.
"There is not enough waste or There is predicted waste to sustain a facility such as the
Arc21 incinerator as proposed."

arc21 in their appeal against Mark H Durkan's refusal of plans for a contentious waste incinerator.
