The second factor, severity of injury, should be analyzed in conjunction with the first factor, product
hazardousness. Thus, if a product is proven hazardous based on extensive safety regulations imposed by government safety organizations, and the injury is caused by a hazard that the regulations intend to prevent against, the severity of the injury should be considered with great weight.
The standard creates a two-part chain of disclosure: First, chemical manufacturers and importers must evaluate the
hazardousness of the substances they produce or import and disclose such information to employers who purchase their products; and second, employers must make this information available to all of their workers who handle hazardous substances.
