The federal Food and Drug Administration reports that tubes of toothpaste coming into our nation's ports by way of China have contained a poison related to a chemical found in antifreeze. The preamble to the proposed rules claims that the express preemption provision of the federal Food, Drug & Cosmetic Act (FDCA) applies not only to state laws or regulations but also to state common law duties.
